1. Legal notice

This website (broadcastwitch.com) and the BW Logger software are published by Line Media, a French simplified joint-stock company (SAS) with share capital of 1,500 euros, registered office at 26 Rue Pierre Robin, 69007 Lyon, France, registered with the Lyon Trade and Companies Register (RCS Lyon 920 988 367), SIRET 920 988 367 00016, VAT number FR41 920 988 367. 2. About these terms

These terms and conditions govern the use of this website, the purchase of BW Logger licenses and the use of the BW Logger software (the "App"). By placing an order or using the App, you accept these terms. If you are buying for a company, you confirm you are authorised to bind it.

3. The product

BW Logger is a desktop application for macOS (Apple Silicon) and Linux that records operations performed on a connected Blackmagic ATEM switcher and exports editing timelines (FCPXML, FCP7 XML and EDL). Using the App requires a computer meeting these platform requirements, a network-reachable ATEM switcher for live logging (a built-in simulator is available without hardware), and an internet connection for the one-time license activation described in section 7.

The App is an independent product of Line Media. It is not affiliated with, endorsed by or supported by Blackmagic Design. Product names such as ATEM, HyperDeck, DaVinci Resolve, Adobe Premiere Pro and Final Cut Pro are trademarks of their respective owners and are used only to describe compatibility.

4. Ordering, price and payment

Orders are processed by our merchant of record, Lemon Squeezy, LLC (part of Stripe). Lemon Squeezy is the seller of record for your purchase: it processes your payment, applies and remits applicable taxes such as VAT based on your country, and issues your invoice. Your purchase is also subject to Lemon Squeezy's terms of sale and privacy policy, available at checkout.

Prices are displayed in euros on this website. The final price, including any applicable taxes, is shown at checkout before you pay. Line Media may change its prices at any time; the price applicable to your order is the one displayed at the time of the order.

Orders are concluded exclusively through the checkout. Messages sent to our contact email address are treated as enquiries only: no sale is concluded by email.

5. Delivery

BW Logger is delivered electronically. After payment is confirmed, your license key and download links are sent to the email address provided at checkout, normally within minutes. If you have not received them within one hour, check your spam folder, then contact contact@broadcastwitch.com.

6. License

Subject to payment, Line Media grants you a personal, non-exclusive, perpetual license to install and use the App. The license is sold per station:

The license includes the updates of the App that Line Media makes generally available to license holders. You may move an activation to another computer by deactivating the App on the old machine (see section 7).

You must not:

Line Media may suspend or revoke license keys obtained fraudulently, subject to a payment dispute or chargeback, or used in serious breach of these terms.

7. Activation and offline use

The App requires a one-time online activation before first use: when you enter your license key, the App contacts our activation service over the internet to register the activation for that computer. After successful activation, the App does not require an internet connection to run. Deactivating a computer to move the license to another one also requires an internet connection at the time of deactivation and reactivation. If an activated computer is lost or defective, contact us and we will release the seat.

8. Right of withdrawal and refunds

If you buy as a consumer in the European Union, you normally have a legal right to withdraw from a distance purchase within 14 days. For digital content supplied immediately, such as a license key delivered right after checkout, EU and French law (article L221-28 of the French Consumer Code) provide that this right is lost when performance has begun with your prior express consent and your acknowledgment that you lose the right of withdrawal. Because Lemon Squeezy is the seller of record, that consent is requested and recorded in its checkout at the moment of purchase, and the conditions shown to you there govern. Nothing on this page removes a right that you have not been asked to waive in that way.

Where the right of withdrawal applies, it runs for 14 days from the conclusion of the contract. You exercise it by sending an unambiguous statement to contact@broadcastwitch.com, for example: "I hereby give notice that I withdraw from my contract for the BW Logger license ordered on [date], name: [your name], email used at checkout: [email]." You may use this wording or any equivalent unambiguous statement. Reimbursement is made within 14 days of the withdrawal, using the same means of payment as the original transaction, at no cost to you. Refunds are processed by Lemon Squeezy as merchant of record.

Independently of the above, if the App does not work on a supported setup and our support cannot fix it, contact us within 14 days of purchase and we will look for a fair solution, which may include a refund.

9. Statutory guarantees

If you buy as a consumer, you benefit from the statutory guarantees applicable to digital content under French and EU law, including the legal guarantee of conformity (articles L224-25-1 and following of the French Consumer Code). Conformity claims are handled by Line Media at contact@broadcastwitch.com, regardless of Lemon Squeezy's role in processing the payment. Nothing in these terms limits rights that the law does not allow to be limited.

10. Support and updates

Support is provided by email at contact@broadcastwitch.com on a reasonable efforts basis. The App is under active development; updates are made available for download to license holders. Line Media does not commit to developing specific future features.

11. Liability

The App is a logging and export tool for post-production workflows. It does not record video or audio; you remain responsible for your recording chain, for verifying exports before relying on them, and for backing up your data. To the extent permitted by applicable law, Line Media's total liability for any claim related to the App or these terms is limited to the amount you paid for the license concerned, and Line Media is not liable for indirect damages such as loss of production, loss of profit or loss of data. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including for consumers the statutory guarantees referred to in section 9.

12. Intellectual property

The App, this website and their content (code, design, text, graphics) are protected by intellectual property law and remain the property of Line Media or its licensors. The license granted in section 6 is a right of use, not a transfer of ownership.

13. Personal data

Personal data is processed as described in our Privacy Policy.

14. Complaints, mediation and governing law

Complaints. Address any complaint first to Loïc Ascarino at contact@broadcastwitch.com. We aim to answer within one business day and to resolve the matter directly.

Mediation. If no agreement is reached, a consumer is entitled under article L612-1 of the French Consumer Code to refer the dispute free of charge to an independent consumer mediator. Line Media is in the process of joining an approved mediation scheme and this clause will name it as soon as that is done. A consumer may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.

Governing law. These terms are governed by French law. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live. Failing an amicable solution, the competent courts will be those determined by applicable procedural rules; for professionals, the courts of Lyon, France have exclusive jurisdiction.

15. Changes to these terms

Line Media may update these terms from time to time. The version applicable to an order is the one published on this website on the day of the order. The date at the top of this page indicates the last revision.
